Terms and conditions

These terms govern your use of thetuitionroom.com and any tutoring services arranged through it (“the Service”). By booking a trial, session, or applying to tutor with us, you agree to these terms.

1. Who we are

The Tuition Room operates as a platform connecting students/parents (“Clients”) with independent tutors (“Tutors”) for online (and where applicable, in-person) tuition.

2. Nature of the service

Tutors are independent contractors, not employees of The Tuition Room. We facilitate the introduction, scheduling, and payment process, but tutors are responsible for the content and delivery of their own lessons.

3. Eligibility

  • Clients booking on behalf of a minor confirm they are the parent or legal guardian of that child, or have the authority to arrange tuition on their behalf.
  • Tutors applying to join the platform confirm that the information provided in their application is accurate and complete.

4. Bookings and trials

  • A free trial session is offered as described on our website, subject to availability.
  • Bookings are confirmed once scheduled via our platform. Both Clients and Tutors are expected to attend at the agreed time.

5. Fees and payment

  • Tutors set their own hourly rate, displayed on their profile or agreed directly through the platform.
  • Clients pay the full quoted hourly rate via the platform.
  • All fees are quoted in USD unless otherwise stated.

6. Tutor conduct

Tutors agree to:

  • Conduct sessions professionally and punctually
  • Communicate with students and parents respectfully and appropriately at all times
  • Not contact students or arrange sessions outside the platform in a way that circumvents these terms
  • Comply with our Safeguarding Policy at all times when working with minors

7. Client responsibilities

  • Provide accurate information when booking
  • Ensure a minor has appropriate supervision/access to a device for online sessions where needed
  • Give reasonable notice for cancellations, per our Cancellation Policy
  • Treat tutors with respect and professionalism

8. Intellectual property

Course materials, worksheets, or resources created by a tutor remain that tutor’s property unless otherwise agreed. Our website content, branding, and platform materials remain the property of The Tuition Room.

9. Disclaimer and limitation of liability

  • We take reasonable care in reviewing tutor applications, but we do not guarantee specific academic outcomes.
  • To the extent permitted by law, The Tuition Room is not liable for indirect or consequential loss arising from use of the Service.
  • Nothing in these terms limits liability that cannot be limited under applicable law (e.g. in relation to gross negligence or wilful misconduct).

10. Suspension and termination

We reserve the right to suspend or remove a Tutor’s profile or a Client’s access to the Service for breach of these terms, including any breach of our Safeguarding Policy, at our discretion.

11. Dispute resolution

If a dispute arises, please contact us first so we can try to resolve it directly. If a dispute cannot be resolved directly, it will be referred to mediation.

12. Governing law

These terms are governed by the laws of the Republic of South Africa, without prejudice to any mandatory consumer protections that apply in a Client’s home country.

13. Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
